Welcome to Southwest Silver Gallery (“we,” “us,” “our,” or the “Company”). These Terms & Conditions (“Terms”) govern your access to and use of our website located at https://www.southwestsilvergallery.com/ (the “Site”) and any related services (collectively, the “Services”). By accessing or using the Site, you agree to be bound by these Terms (and our Privacy Policy). If you do not agree, do not use the Site.

1. Eligibility; Account

Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Services. By using the Site, you represent and warrant that you are of legal age to form a binding contract and that you will comply with these Terms.
Account Registration. To make purchases or access certain features, you may be required to register for an account. You agree to provide accurate, current, and complete information, and to keep it updated. You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized use or breach of security.
Account Termination. We reserve the right to suspend or terminate your account (or your access to the Services) at any time and for any reason, without notice.

2. Products, Orders, Pricing & Payment

Product Descriptions. We strive to display as accurately as possible the attributes of the products, including color, dimensions, weight, materials, etc. However, we do not warrant that product descriptions or other content on the Site are perfectly accurate, complete, reliable, current, or error-free.
Prices & Taxes. Prices for products are subject to change without notice. We reserve the right to correct pricing errors and to refuse or cancel any order (even if already confirmed), including after the order has been processed. You are responsible for all applicable taxes, duties, and fees associated with your purchase.
Payment. You agree to pay all amounts due for items ordered, including shipping charges and applicable taxes, by means we accept (e.g. credit card, PayPal, etc.). You represent and warrant that you have the legal right to use any payment method you provide. We reserve the right to decline or cancel orders in our discretion.
Order Acceptance & Confirmation. Receipt of an order confirmation from us does not constitute acceptance of your order. We reserve the right to accept or reject your order for any reason, including but not limited to: product availability, pricing errors, fraud concerns, or other issues. If we reject an order after charging you, we will refund the amount.

3. Shipping, Delivery & Risk of Loss

Shipping. We will arrange for shipment of the product to the address you specify. Shipping times are estimates and may vary due to factors beyond our control. We are not liable for delays.
Risk of Loss. Title and risk of loss pass to you upon delivery to the carrier or at the time the item is marked as shipped (depending on carrier). Once the item is in transit, you assume risk for damage or loss, unless we have expressly agreed otherwise.
Customs, Duties & Import Taxes. For orders shipped internationally, you are responsible for all customs fees, import duties, and taxes. We are not responsible for delays caused by customs or additional charges imposed by local authorities.

4. Returns, Refunds & Exchanges

Satisfaction Guarantee / Return Policy. We offer a 30-day return or exchange policy. You may return any item within 30 days of receipt (or, for holiday gifts, by January 10th) in its original condition for a refund or exchange. (See our “Guarantee” statement on the Site.) southwestsilvergallery.com
Return Procedure. To initiate a return or exchange, you must contact us and follow the instructions. Items must be returned in the same condition (unused, undamaged, with original packaging). You may be responsible for return shipping costs, unless we specify otherwise (for example, free shipping on exchanges of equal or greater value, as noted on the Site). southwestsilvergallery.com
Refunds. Upon receiving and inspecting the returned item, we will notify you whether your refund has been approved. If so, we will issue a refund to your original payment method (excluding shipping charges) within a reasonable timeframe.

5. Intellectual Property

Ownership. All content on the Site, including text, graphics, logos, images, audio, video, software, and other materials (“Content”), is owned or licensed by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
License to You. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content for your personal, non-commercial use, subject to these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any Content in whole or in part without our prior written consent.
User Contributions. If you post reviews, comments, or other content on the Site, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

7. Disclaimers & Limitation of Liability

No Warranties. The Site and Services are provided “as is” and “as available” without warranties of any kind (express, implied, statutory). To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information.
Limitation of Liability. To the maximum extent permitted by law, in no event shall we, our affiliates, directors, officers, employees, agents, or suppliers be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use or inability to use the Site or products, even if we have been advised of the possibility of such damages.
Cap on Liability. Except for liability required by law (e.g. for gross negligence or wilful misconduct), our total aggregate liability to you for all claims arising from or relating to these Terms or your use of the Site shall not exceed the total amount you paid us in the 12 months prior to the event giving rise to the claim (or, if no purchase, one hundred U.S. dollars (USD $100)).
Indemnification. You agree to indemnify, defend, and hold harmless Southwest Silver Gallery and its affiliates, officers, directors, employees, agents, and licensors from and against all claims, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Site or its Content.

Third-Party Links. The Site may contain links to third-party websites or resources. We are not responsible for the content, policies, or practices of those third parties. You access them at your own risk.
Third-Party Services. We may use third-party services (e.g. payment processors, shipping carriers, analytics). Your use of such services may be subject to their own terms.

10. Termination & Suspension

We may, in our sole discretion, suspend or terminate your access to the Site (including your account) at any time, with or without cause or notice. Sections that by their nature are intended to survive will survive termination (e.g. Intellectual Property, Disclaimers & Liability, Indemnification).

11. Governing Law & Dispute Resolution; Arbitration (Optional)

Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
Dispute Resolution. Any dispute arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation. If unresolved, disputes may be resolved in the state or federal courts located in Archeleta, Colorado. You consent to exclusive jurisdiction and venue in those courts.

12. Changes to Terms

We may revise these Terms from time to time in our discretion. We will post the updated Terms on the Site with a new “Last Updated” date. By continuing to use the Site after changes are posted, you agree to be bound by the revised Terms.

14. Miscellaneous

Entire Agreement. These Terms (together with the Privacy Policy and any other legal notices posted on the Site) constitute the entire agreement between you and us regarding the Site, superseding any prior agreements.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
Waiver. Our failure to enforce any right or provision does not constitute a waiver.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign or delegate these Terms without restriction.
